RENO, Nev. (AP) ? A quirky Nevada law that Republicans feared could siphon votes from a disgruntled electorate and sway the outcome of close presidential and U.S. Senate races in the state was struck down Wednesday by a federal judge.
U.S. District Judge Robert Jones said the state's decades-old ballot alternative of "none of the above" was unconstitutional because votes for "none" don't count in the final tallies that determine winners.
The ruling came at the end of a lively hearing where the judge challenged both sides in the legal arguments with hypothetical questions and ramifications of possible rulings he was considering.
In the end, he struck the option down altogether for both federal and statewide races, and refused to grant a stay while his decision is appealed to the 9th U.S. Circuit Court of Appeals.
Secretary of State Ross Miller said his office would pursue "an immediate and expedited appeal to protect the long-standing public interest of the 'none of these candidates' option."
A federal lawsuit filed in June and bankrolled by the Republican National Committee argued Nevada's unique voter option, which has appeared on every election ballot for statewide races since 1976, disenfranchises voters because it's a perpetual loser. Under state law, even if "none" receives the most votes, it doesn't win. Victory is reserved for people, though "none" before has played a role in determining the winner in some high-profile races.
"We're glad we were successful in our efforts to bring clarity to the Nevada presidential election ballot," the RNC said in a statement when asked for comment.
Deputy Attorney General Kevin Benson, representing the secretary of state, argued voters "always have the right to not vote" for listed candidates, and that voting for "none" is essentially no different than skipping a particular race on a ballot altogether or not voting at all.
"You're free to stay home on the couch," he said, arguing that such non-votes don't count either.
The "none" option, he argued, was akin to a protest vote that allows voters to communicate with politicians that they are unhappy with their choices.
"The purpose of the option is to send a clear message," he said
But the judge disagreed, and early in the hour-long hearing said he believed that a "none" vote was indeed a vote that should be counted toward election results, and not just to register a protest.
"I don't buy your arguments that it isn't a vote, because it is a vote," Jones said.
At one point Jones suggested that requiring votes for "none" to be counted and binding would satisfy the legal challenges raised in the lawsuit. If "none" got the most votes, nobody would be elected and the vacancy could be filled by governor appointment, he theorized.
Instead, he granted an injunction to strip "none" from the Nevada ballot.
Nevada is the only state to offer the "none" option. It was a way to combat voter apathy after the Watergate scandal that brought down President Richard Nixon and give them a chance to register their disdain for their choices. "None of these candidates" has been a choice for races where voters statewide cast ballots ? the president, U.S. Senate, state constitutional officers and Nevada Supreme Court justices.
While the law says "none" can't win, it could have played spoiler in a close race.
"None" has never bested named candidates in a general election, though it has come out on top in a few primary contests. In the 1998 U.S. Senate race, however, Democrat Harry Reid won re-election by 428 votes over then-GOP Rep. John Ensign. More than 8,000 voters rejected both men and opted to vote for "none."
That's a scenario the option's challengers didn't want to see this year. The contest between President Barack Obama and presumptive Republican nominee Mitt Romney promises to be close, as does the one between GOP U.S. Sen. Dean Heller and his Democratic challenger, U.S. Rep. Shelley Berkley.
Conventional thinking suggests voters who select "none" may be more likely to favor a challenger, such as Romney, if the option wasn't available.
Michael Morley, in his argument to boot the "none" option, argued that the Voting Rights Act and other laws are designed to ensure everyone's votes are counted.
He argued a vote for "none" was an affirmative, deliberate action, as opposed to waiving one's right to vote in a particular race, and that "none" votes can affect the outcome.
Jones said he would issue a written order detailing his legal analysis at a later date but before Sept. 7, when state elections officials said ballots have to ready for printing.

But for Guerra, who grew up in the Rio Grande Valley, the opportunity to come home was too great to pass up.
?There really was no question for me,? Guerra said, from his office overlooking Cage Blvd. ?I knew I could help the City regain its financial health and the added benefit was that I would be close to my parents.?
Now, Guerra?s star is on the rise in Pharr. Since coming on board in 2007, Guerra has earned the respect of City Manager Fred Sandoval, City Commissioners and other department heads because he was able to bring the City back from the brink of bankruptcy to a sound financial footing without the need for layoffs or cuts in services. His management has led to a surplus in the City?s general fund, annual budgets are now submitted to appropriate agencies on time, and the City is primed to focus on economic development, thanks to sound planning.
While these achievements are indeed substantial; none of them were easy. It took nearly two years to turn things around.
?When I started here, the City?s finances were in disarray, audits were late and had been for 18 consecutive years and the City?s bond rating had been downgraded to just a step above junk bond status because of poor fiscal policies, a lack of monitoring, and unreliable financial reports,? Guerra recalled.? ?Also, the unrestricted fund balance in the City?s general fund was negative by more than $6 million.? ?
Guerra explained that revenue is generated from property and sales taxes the nicer homes bring in more tax revenue and residents who tend to spend more on shopping and dining out, which drives sales taxes. But there seemed to be no planning or thought given to how the City would grow. So, the majority of the developments were for low-to-moderate properties which didn?t generate enough taxes to cover the City?s expenses for infrastructure and basic services.
?It was a catch 22. Developers need infrastructure to put a stake in the ground, but the City couldn?t afford to do it,? Guerra said. ?That?s probably why the cities of Mission, McAllen and Edinburg were able to flourish while Pharr didn?t. There was no malfeasance that I could find. I think the problem was that the City?s population outpaced the property and sales tax revenue.?
The former Marine was up for the challenge, but credits Sandoval for allowing him the autonomy to implement his strategy and plan.
?The City Manager hired me because of my skill and expertise and then supported me,? Guerra said. ?I spent countless hours correcting the documentation process and updating the balances of all the accounts in the general ledger.?
He then identified major financial weaknesses and developed a long-term viability plan to correct them and ensure that they don?t occur again in the future.
?I called it the 12-Step Fiscal Plan of Action, not realizing that Alcoholics Anonymous also uses a 12-step plan,? he said, grinning. ?But I understand that the first step is very similar in both ? recognize that you have a problem.?
In less than four years, Guerra?s 12-step plan has led to a surplus in the City?s general fund and increased the City?s bond rating to AA minus. The City has also received its third Distinguished Budget Presentation Award from the Government Finance Officers Association, something which most City?s expect from their Finance Department, but which the City of Pharr had never received.
The list of Guerra?s accomplishments is truly amazing, from completing the City?s audit on time for the first time in 19 years to receiving state recognition. Here are a few:
Developed an investment report that meets professional investment requirements; Awarded the Governmental Treasury Organization of Texas? Certificate of Distinction in two consecutive years; Modified the City?s website to become the first in the region to win the Gold Leadership Circle for its online fiscal transparency; and successfully managed the City?s finances through the regional economic downturn while producing a balanced budget with no layoffs.

Aug 17, 2012 - After getting nothing but extremely unhelpful Ray Allen comparisons during the 2012 NBA Draft, St. Louisan and Washington Wizards first-rounder Bradley Beal excelled in his first chance to play in an NBA uniform; in July he was named a member of the All-Summer League Team for averaging 17.6 points a game in the exhibition contests. That's led people to wonder just how much playing time he's going to get to start the 2012-2013 season.
The positional battle, such as it is, is between Beal and Jordan Crawford, a third-year shooting guard who averaged 14.7 points across 64 games and 32 starts in his first full season with the Wizards.
If the Wiz have any confidence in Beal, this seems like a positional battle in name only. Crawford's career field goal percentage is .394, and he's not a particularly good three-point shooter, either; his points per game, third on the team, came primarily because the Wizards had no other options.
The Summer League isn't the kind of thing that's going to make or break a first-rounder's career?or his rookie season, for that matter?but it seems like nothing but further confirmation that Beal's ready to perform in the NBA, even if he's not quite ready to, uh, be Ray Allen.

Spread betting is a form of gambling where you wager on any of the possible outcomes of an event. It took quite a long while for the financial markets to finally openly accept the fact that trading the financial markets is indeed a form of gambling. But the introduction and adoption of CFDs by practically all the financial markets as a tradable derivative product confirmed this fact.
CFD stands for ?Contract for Difference? or simply a contract entered into by a trader and the CFD provider which says that the seller will pay the buyer an amount equivalent to the difference between the current value of a financial asset and its value at the time the contract was made and if the difference in the values happens to be negative then the buyer will be the one to pay the seller.
Under this set up, the CFD provider matches the trade made by trader meaning if the trader buys, the CFD provider sells and if the trader sells then the provider acts as the buyer and matches the trade. The trader essentially puts a wager on the direction the underlying asset is headed by initiating a buy or sell order. Take note that the trader is not buying or selling the actual asset but merely betting on where the price of the asset is headed. He puts in a buy if he thinks the price is headed upwards and sells if the price is headed south. Either way the trader places his bet, the CFD provider matches his trade with an opposite trade (selling when the trader buys and buying when the trader sells).

Myanmar's parliament on Wednesday appointed the navy chief to replace a regime hardliner as one of the country's vice presidents, in a move seen as strengthening government reformers.
Admiral Nyan Tun, 58, who has a reputation as a political moderate, was selected by the military personnel who make up one quarter of the legislature and have the right to choose one of the two vice presidents.
"I will carry out my responsibilities honourably to the best of my ability and strive for the further development of the eternal principles of justice, liberty and equality," Nyan Tun said in his oath of office.
His appointment was approved by an electoral college, house speaker Khin Aung Myint announced at a joint session of the lower and upper houses of parliament in the capital Naypyidaw.
"He's very quiet and known as a flexible man," a military parliamentarian who did not want to be named said of the new vice president. "He has three children and lives a simple life."
His predecessor Tin Aung Myint Oo -- a renowned hardliner with close links to ex-junta chief Than Shwe -- resigned in July ostensibly due to ill health, fanning rumours of a power struggle between regime moderates and conservatives.
Since taking office last year, President Thein Sein, a former general, has overseen dramatic changes such as the release of hundreds of political prisoners and the election of opposition leader Aung San Suu Kyi to parliament.
The army's first candidate, Yangon chief minister Myint Swe, failed to win approval because his son-in-law is an Australian citizen, which under the constitution disqualified him from becoming a vice president.
"The Yangon chief minister is not qualified to be a vice president because of his Australian son-in-law. Military representatives changed the nomination in the last week of July to Admiral Nyan Tun," a parliamentary source told AFP.
The same provision is a barrier to Suu Kyi taking a top leadership role in the country, and her party has vowed to campaign to completely redraw the constitution, which was written by the former junta.
Myint Swe, a retired general, was one of the military leaders involved in a deadly crackdown on the "Saffron Revolution" monk-led uprising in 2007.

ScienceDaily (Aug. 14, 2012) ? Pioneering mass spectrometry methods developed at the U.S. Department of Energy's (DOE's) Ames Laboratory are helping plant biologists get their first glimpses of never-before-seen plant tissue structures.
The new method opens up new realms of study, ones that might have long-ranging implications for biofuels research and crop genetics.
"The data we're seeing are unprecedented," said Basil Nikolau, the Ames Laboratory faculty scientist heading up the project, funded by DOE's Office of Science.
The laboratory's team of researchers has developed a new more highly sensitive mass spectrometry technique to investigate metabolites, the small molecules that are the building blocks for plant biological processes.
Young-Jin Lee, a faculty scientist in Ames Laboratory's Chemical and Biological Sciences Division, has successfully demonstrated the use of matrix-assisted laser deposition/ionization-mass spectrometry, or MALDI-MS, to map the lipids in cottonseed in a recent paper published in The Plant Cell, a premier research publication in plant science.
The research group's technique is also featured in a paper published in a special issue of The Plant Journal, highlighting new developments in high resolution measurements in plant biology. The imaging technique can make maps of the locations of molecules in plant materials with resolution of 10 to 50 microns, less than a quarter the size of a human hair.
MALDI-MS has been in use in the medical and pharmaceutical fields for about the last decade, Lee said.
"In the medical field researchers were using this type of spectrometry to map proteins in human cancers and visualize the distribution of drugs through tissues. But in recent years the scientific community began to look at MALDI-MS as a possibility for mapping metabolites in plant material," said Lee.
Traditional methods in gas chromatography and mass spectrometry told plant biologists the "what and how much" of plant metabolites, but not the "where."
"Before these advances, in order to analyze plant material, biologists were forced to crush up tissue. We would lose spatial information, where these metabolites were located in different types of plant cells," said Nikolau.
"The traditional methods provided qualitative and quantitative analysis, but it lost all localization of these small molecules," said Lee. "With this technique we can see the distribution of these metabolites in the plant tissue at the single cell level."
In Lee's study of cottonseeds, done in partnership with a team of U.S. and German scientists, the technique showed a distribution of lipids that varies with tissue function. The knowledge could yield useful information about cottonseed, a crop valued as a possible source of biofuel and for its oil in the food industry.
"This information is really so new to scientists that we don't know yet what it means. As a matter of fact, it challenges plant biologists at the moment to take hold of that data and integrate it into the way they do their science," said Nikolau. "This data will change the future of how we do research."
Lee said that though there was still much to learn about developing procedures using MALDI-MS to detect the tiny amounts of material in cells, he expects the use of the technique in plant science to gain wider use.
"Up until this point, this method has not really been recognized by plant scientists. But we were able to bring the technologies of analytical chemistry to the biological science problem of being able to map molecules at the single cell level. There is still a lot to learn about the process, but this technique is going to blossom very rapidly in the next few years."
Nikolau believes the technology will be a key to thoroughly understanding plant biosynthesis, and in turn alternative energy production.
"This is really about the sustainability of our chemical world," he said. "When you're talking about chemical energy, you're talking about carbon. Historically, over the last 100 years, it's been carbon from petroleum. If you're going to make biorenewable chemicals, the carbon comes in through photosynthesis, through plants. That process happens in discrete compartments within the organism, within individual cells. Science needs to know that highly detailed spatial information to take full advantage of it."

Captain Cook discovered Australia?s Great Barrier Reef in 1770, when his ship smashed into it ?and stuck fast,? as he put it in his journal. The seven-week layover that followed gave Cook?s men glimpses of a strange menagerie.
Mostly, it was the reef?s teeming fish they came to know. ?We see them in plenty jumping about the harbour,? Cook wrote. Soon, his men were hauling them in.

Harnessing the power of the sun is a tricky business, but even the past few weeks have seen some interesting developments in the field. In this latest installment, researchers from the Lawrence Berkeley National Laboratory and the University of California have figured out a way of making solar cells from any semiconductor, potentially reducing the cost of their production. You see, efficient solar cells require semiconductors to be chemically modified for the current they produce to flow in one direction. The process uses expensive materials and only works with a few types of semiconductors, but the team's looking at using ones which aren't normally suitable -- the magic is to apply an electrical field to them. This field requires energy, but what's consumed is said to be a tiny fraction of what the cell's capable of producing when active, and it means chemical modification isn't needed.
The concept of using a field to standardize the flow of juice isn't a new one, but the team's work on the geometrical structure of the cells has made it a reality, with a couple of working prototypes to satisfy the skeptics. More of these are on the way, as their focus has shifted to which semiconductors can offer the best efficiency at the lowest cost. PASADENA, Calif. (AP) ? The ancient Martian crater where the Curiosity rover landed looks strikingly similar to the Mojave Desert in California with its looming mountains and hanging haze, scientists said Wednesday.
"The first impression that you get is how Earth-like this seems looking at that landscape," said chief scientist John Grotzinger of the California Institute of Technology.
Overnight, the car-size rover poked its head out for the first time since settling in Gale Crater, peered around and returned a black-and-white self-portrait and panorama that's still being processed.
It provided the best view so far of its destination since touching down Sunday night after nailing an intricate choreography. During the last few seconds, a rocket-powered spacecraft hovered as cables lowered Curiosity to the ground.
In the latest photos, Curiosity looked out toward the northern horizon. Nearby were scour marks in the surface blasted by thrusters, which kicked up a swirl of dust. There were concerns that Curiosity got dusty, but scientists said that was not the case.
"We do see a thin coating of dust, but nothing too bad," said Justin Maki, imaging scientist at NASA's Jet Propulsion Laboratory, which manages the $2.5 billion mission.
Scientists were giddy about the scour marks because they exposed bedrock below ? information that should help them better understand the landing site.
Since landing, Curiosity has zipped home a stream of low-resolution pictures taken by tiny cameras under the chassis and a camera at the end of its robotic arm, which remained stowed. It also sent back a low-quality video showing the last 2 1/2 minutes of its descent.
The rover successfully raised its mast packed with high-resolution and navigation cameras. With the mast up, it can begin its shutterbug days in force, including taking a 360-degree color view of its surroundings as early as Thursday.
Grotzinger said he was struck by the Martian landscape, which appeared diverse. There seemed to be harder material underneath the gravelly surface, he said.
"It kind of makes you feel at home," he said. "We're looking at a place that feels really comfortable."
Mars, of course, is very different from Earth. It's a frigid desert constantly bombarded by radiation. There are geological signs that it was a warmer and wetter place once upon a time. One of the mission's goals is to figure out how Mars transformed.
After sailing 352 million miles and eight months, Curiosity parked its six wheels near the Martian equator, where it will spend the next two years poking into rocks and soil in search of the chemical ingredients of life. It is the most expensive and ambitious mission yet to Mars.
Its ultimate destination is a mountain towering from the center of the crater floor. Preliminary estimates indicate Curiosity landed four miles away from the base of Mount Sharp, thought to contain intriguing signs of past water ? a starting point to learning whether microbial life could exist.
Before the 1-ton, nuclear-powered Curiosity can start roving, it has to undergo several weeks of tedious but essential health checks.
Since it was too heavy to land using traditional air bags, it used a heat shield, parachute, rockets and cables. An orbiting spacecraft spotted the discarded spacecraft hardware, including the ballast weights that were shed soon after entry into the atmosphere.
